David C. Kurtz is of counsel to Prince Lobel Glovsky & Tye's Employment Law Practice Group. He concentrates his practice on labor and employment law, including litigation, arbitration and mediation. David counsels companies on all aspects of various day-to day matters such as hiring/firing decisions, employee handbooks, employee discipline, severance agreements, wage and hour laws, and general compliance with federal, state and local employment statutes, regulations and case law. In his broad "traditional" labor law practice, David represents clients in all facets of the management-union relationship, including negotiations/collective bargaining, elections, disciplinary arbitrations, contract interpretation arbitrations and unfair labor practice charges. David has significant experience before the DOL, EEOC, MCAD and NLRB.
David counsels clients in connection with claims related to restrictive covenants (including confidentiality agreements, covenants-not-to-compete and non-solicitation agreements), and the misappropriation of trade secrets, corporate property and corporate opportunities. David has represented unionized and non-unionized employers ranging from Fortune 500 companies to high-tech start-ups, as well as executives in employment-related matters.
David has authored several articles, and has served on various seminar panels. His publications include Section 504: May Require Rule Waivers for Athletes, Section 504: Compliance Handbook, Telecommuting: Practical and Legal Considerations, 9 HR Advisor 22, and Employment Policies and Procedures Audits, 6 HR Advisor 12.
David is admitted to practice in the Commonwealth of Massachusetts, the state of New York, the United States Court of Appeals for the First Circuit, the United States District Court for the District of Massachusetts, the United States District Court for the Eastern District of New York, and the United States District Court for the Southern District of New York. He is a member of the Massachusetts Bar Association and he is also a member of the Boston and Worcester County Bar Associations.
Prior to joining Prince Lobel, David was a Director and Chair of the Labor & Employment Practice Group at Fletcher, Tilton & Whipple in Worcester, Massachusetts, and a Labor & Employment attorney in the Boston offices of Foley Hoag LLP and Choate Hall & Stewart LLP. David received his undergraduate degree in Government from the University of Virginia in 1995. He earned his J.D., cum laude, from Boston College Law School in 1998, where he served as an Editor of the Boston College Law Review.
